ارزیابی حدود «تعهد دولت‏ ها به پیشگیری و همکاری» در مبارزه با جرایم بین‏ المللی با تأکید بر معاهدۀ تجارت تسلیحات

چکیده
ریشه‌کن کردن قاچاق تسلیحات، به‌منزلة یک جرم سازما‌ن‌یافتة فراملی و همچنین زمینه‏ای که برای ارتکاب سایر جرایم بین‏المللی فراهم می‏آورد، جایگاهی کلیدی در موفقیت حقوق کیفری بین‏المللی در پیشگیری از جرایم بین‏المللی دارد. سهم عمدة کنوانسیون‌های مبارزه با جرایم تسلیحاتی در‏ اسناد حقوق کیفری بین‏المللی و کنوانسیون‌های خلع سلاح در حقوق بین‌الملل بیان‌کنندة همین مضمون است. تلاش‏‏ به منظور ریشه‌کن کردن انحراف تجارت بین‏المللی تسلیحات به سمت بازارهای غیر قانونی، با تصویب معاهدة تجارت تسلیحات در سال 2013، شکلی تازه به خود گرفته است. این معاهده، به منظور کنترل تجارت تسلیحات، برای جلوگیری از انحراف آن‏ها به سمت بازارهای غیر قانونی و ارتکاب جرایم بین‏المللی، تعهداتی را بر اعضا تحمیل کرده است که تعهد دولت‏ها به همکاری در اجرای این تعهدات از جملة آن‏هاست. به نظر می‏رسد ضوابط و تعهدات معاهدة تجارت تسلیحات در مبارزه با قاچاق تسلیحات تعهد دولت‏ها را به همکاری درخصوص مبارزه با جرایم بین‏المللی، که به‏کارگیری سلاح لازمه یا زمینة ارتکاب آن‌هاست، عینیت بخشیده و تا حدودی موجب شفافیت تعهدات دولت‏ها در این خصوص شده است؛ که پیش‏تر در سایر اسناد حقوق کیفری بین‏المللی، نظیر کنوانسیون ملل متحد برای مبارزه با فساد و کنوانسیون علیه جنایت سازمان‌یافتة فراملی و کنوانسیون‏های چهارگانه ژنو، آمده بود. لیکن برخی کاستی‏ها در معاهده سبب شده معیارهای ارائه‌شده به‌تنهایی در ارزیابی اجرای تعهد دولت‏ها به همکاری در مقابله با جرایم بین‏المللی و از جمله قاچاق تسلیحات کارآمد نباشند.

چکیده English

Eradication of arms trafficking, as a transnational organized crime and a ground for other international offenses, plays a key role in prevention of such crimes in International Criminal Law. The considerable number of conventions against offenses relating to arms in instruments of International Criminal Law on the one hand, and conventions on disarmament in International Law on the other, is a testament to the importance of said role. With ratification of the Arms Trade Treaty (ATT) in 2013, The United Nation's General Assembly reshaped the efforts to prevent the deviation in Arms Trade towards black markets as the Treaty imposes obligations on member States to that end. Although previously incorporated in documents such as Merida, Palermo and the Geneva Conventions to some extent, the obligation to cooperate seems to have been materialized by the rules and standards of the ATT against arms contraband. Naturally, the Treaty's rules are applicable in international judicial bodies. However, in terms of practicality, lack of adequate measures of evaluation concerning the performance of States in their commitment to prevention of crimes with a global nature and their cooperation in that capacity, serves as a potential obstacle to the sufficiency of ATT's standards.
