حاشیۀ صلاحدیدی در اجرای قطعنامه‌های تحریمی شورای امنیت: بررسی موردی ایران

چکیده

قطعنامه‌های شورای امنیت سازمان ملل متحد صادره در چارچوب فصل هفتم منشور ملل متحد از قدرت الزام‌آور برخوردارند. هنگامی‌که شورا قطعنامه‌ای براساس فصل هفتم صادر می‌کند، وضعیت‌های مهم مندرج در مادۀ 39 منشور را مدنظر قرار می‌دهد و برای رسیدن به این هدف، صرفاً نتیجۀ موردنظر را از مخاطبان قطعنامه مطالبه می‌کند. در این میان، دولت‌های عضو ملل متحد برای رسیدن به هدف مزبور شیوه‌ها و ابزارهای موجود را برای اجرا مدنظر قرار می‌دهند. با این حال، اینکه دولت‌ها چگونه و از چه میزان حاشیۀ صلاحدیدی برای اجرای تصمیمات شورای امنیت بهره‌مندند، موضوعی است که در این نوشتار در چارچوب قطعنامه‌های شورای امنیت، عملکرد دولت‌ها و رویۀ قضایی با تأکید بر قطعنامه‌های تحریمی شورا در مورد ایران بدان پرداخته خواهد شد.

چکیده [English]

United Nations Security Council (SC) resolutions adopted under Chapter VII of the UN Charter are binding. Whenever SC adopts a resolution under Chapter VII, it will consider significant situations indicated in article 39 and in order to reach to this end, requesting the mere final result from addressees of the resolutions. In this regard, UN member States to enforcement the resolutions select their own available means to achieve the goal of the resolution. Whether and to what extent member States the margin of appreciation to enforce the SC decisions have, would be the main point of this paper which, in turn, will be analyzed from the SC resolutions, States practice and case law perspective as to the sanctions stipulated by SC on Iran.
