مرجع صالح در نظارت بر اجرای سیاست‌های کلی نظام، وحدت یا تعدد؟

چکیده

با توجه به ماهیت هنجاری نهاد سیاست‌های کلی نظام، تردیدی در ضرورت وجود نظارت مؤثر و کارامد بر اجرای این سیاست‌ها وجود ندارد. اگرچه در مورد کیفیت این نظارت و ضمانت اجرای آن اختلافاتی میان حقوقدانان بروز یافته است، به‌نظر می‌رسد یکی از اقتضائات شأن هنجاری سیاست‌های کلی نظام لزوم پذیرش ضمانت اجرای حقوقی و قانونی برای تحقق این سیاست‌ها در سطوح مختلف نظام حقوقی ایران خواهد بود. از طرفی بند 2 اصل 110 قانون اساسی به صلاحیت رهبری در امر نظارت بر اجرای سیاست‌های کلی تصریح کرده است. ازاین‌رو این سؤال مطرح شده که در نظام حقوقی ایران صلاحیت نظارت بر اجرای سیاست‌های کلی نظام به چه مراجعی واگذار شده است؟ در این پژوهش تلاش شده با روش توصیفی-تحلیلی پاسخ روشنی به پرسش مذکور داده شود و در نهایت با تحلیل ارادۀ مقنن اساسی در این زمینه، فرضیۀ پژوهش که شناسایی صلاحیت همزمان برای رهبری و سایر مراجع نظارتی است، تأیید و چنین تبیین شده است که اگر مرجعی صلاحیت ذاتی نظارت بر اجرای سیاست‌های کلی نظام را داشته باشد، می‌تواند و باید در حیطۀ صلاحیتی خود به اعمال این نظارت بپردازد و صلاحیت رهبری محدودیتی در این زمینه ایجاد نخواهد کرد.

چکیده [English]

According to the normative quiddity of the general policies of the regime, there is no doubt in necessity of efficient supervision to implementation of the general policies of the regime. Although there are disagreements about manner of this supervision and their sanctions between lawyers, It seems one of consequences of normative quiddity of the general policies is acceptation of legal sanctions to implementation of this policies in different grades of norms. On the other hand second clause of Article 110 of the Constitution mentions competency of leader to supervision to implementation of the general policies. Therefore this question has been raised what is the relation between competency of leader and competency of other supervisory organizations? In this research is tried to answer this question with descriptive- analytical method. Finally with analysis will of constitutional legislator is confirmed the hypothesis of this research that is identify simultaneous competency of leader and other supervisory organizations. If an authority has original competency to supervision to implementation of general policies in Iranian legal system, It can and must applies this task in its jurisdiction and competency of leader don’t restrict their competency.
