چالش‏های همکاری دولت‏ها در اجرای تعهدات حقوق بشری

چکیده
کثرت هنجارسازی در برخی حوزه‌های حقوق بشر که از نظام ضمانت اجرایی ضعیفی برخوردار است از یک سو و تفسیر امنیت بین‌المللی در دامنة منافع ملی دولت‌ها از طرف دیگر، روابط بین‌المللی دولت‌ها را در حوزة تعهداتی این نظام حقوقی همچنان نامتحد و ازهم‌گسسته نگه داشته است که به‌ناچار، شناسایی رویکرد جدید رژیم‌سازی حقوق بین‌الملل را می‌طلبد که در کارزار موازین حقوقی و معادلات سیاسی، کانون توجه راه‌حل را به سمت نظام همکاری بین دولت‌ها سوق می‌دهد که البته با مشکلاتی مواجه است. در این پژوهش به کمک روش توصیفی ـ تحلیلی، درصدد ارائة نمای کلی از ضرورت همکاری بین‌المللی میان دولت‌ها و شناسایی چالش‌های پیش ‌روی آن در راستای اجرای قواعد حقوق بشر هستیم. یافته‌ها نشان می‌دهد که تقویت سازوکارهای ضمانت اجرا از سوی نهادهای بین‌المللی و توسعة بسترهایی که بتوان همکاری دولت‌ها را نه در قالب اصلی سیاسی، بلکه در قالب مسئولیت حقوقی نهادینه کرد، راهکارهای مطلوبی خواهند بود.

چکیده English

The plurality of norms in some areas of human rights with poor enforcement guarantees, on one hand, and the interpretation of international security in the domain of national interests, on the other, have kept disrupting the international relations of states regarding human rights. Inevitably, it will require the identification of a new approach to international law-making that leads to a focus on a system of cooperation between states in the field of legal norms and political equations, which, of course, is difficult. In this research, using a descriptive-analytical approach, we seek to provide an overview of the need for international cooperation between states and to critique the challenges that it faces in implementing human rights law. The findings of this study suggest that strengthening the mechanism of enforcement by international institutions and developing mechanisms to institutionalize the cooperation of states, not in the form of political responsibility but in the form of legal responsibility that would be desirable solutions.
