جایگاه و کارکرد اصول کلی حقوق در حقوق بین‌الملل سرمایه‌گذاری

چکیده
در عین اختلافات موجود در خصوص اصول کلی حقوق مقبول ملل متمدن، به‌عنوان سومین منبع مندرج در بند نخست مادۀ 38 اساسنامۀ دیوان بین‌المللی دادگستری که منجر شده از یک سوی، برخی پایبندان به نص بند مزبور، اصول کلی حقوق را منبع اصلی و مستقل حقوق بین‌الملل بپندارند و برخی از سوی دیگر، جایگاه آن را به پایة ابزار رفع خلأ حقوقی تنزل دهند، جایگاه و کارکرد این اصول در حقوق بین‌الملل سرمایه‌گذاری و دعاوی میان دولت-سرمایه‌گذار خارجی اعتلا یافته است. در مقالۀ پیش رو، به شواهد اعتلای جایگاه اصول در این شاخه از حقوق بین‌الملل پرداخته خواهد شد.

چکیده English

Longstanding disputes over general principles of law as enumerated in Article 38 of the ICJ Statute has led some to consider these principles as an independent source of international law while others reduce their function to mere gap-filling in non-liquet situations. Nevertheless, international investment law and investor-state arbitrations have proved to be a fertile ground for the influence of general principles. This seeming evolution of the role and functions of general principles as regards international investment law is the subject of this paper.
