رویکرد فرجام‌گرایانه در تفاسیر عمومی کمیتۀ حقوق بشر

چکیده
در میان نهادهای معاهده‌ای که نظارت بر اجرای معاهدات حقوق بشری را بر عهده دارند،  کمیتۀ حقوق بشر به‌عنوان نهاد ناظر  بر میثاق بین‌المللی حقوق مدنی و سیاسی جایگاه ویژه‌ای دارد. از جمله کارکردهای این کمیته تصویب به اصطلاح تفاسیر عمومی است. «تفسیر عمومی» در اصطلاح به سندی اطلاق می‌شود که  کمیته در آن نظر تفسیری خود را دربارۀ مقررات میثاق بین‌المللی حقوق مدنی و سیاسی بیان می‌کند. بنابراین تفاسیر عمومی  کمیتۀ حقوق بشر جلوه‌گاه بارز تفسیر محتوای معاهده محسوب می‌شود. از سوی دیگر، در راستای مکاتب مختلف تفسیر، روش‌های مختلفی نیز برای تفسیر معاهده وجود دارد که هر کدام رهیافت ویژۀ خود را برای فهم معنای متن ارائه می‌دهند. سؤالی که در این خصوص مطرح می‌شود این است که با لحاظ روش‌های مختلف تفسیر معاهده، کمیتۀ حقوق بشر چه روشی را در تفاسیر عمومی خود به‌کار می‌گیرد؟  برای پاسخ به این پرسش، نوشتار حاضر به شیوۀ توصیفی-تحلیلی و با رویکرد استقرایی برای بهره‌گیری از یافته‌های آماری، سیطرۀ شیوۀ تفسیر فرجام‌گرایانه در تفاسیر عمومی کمیتۀ حقوق بشر را نتیجه می‌گیرد.

چکیده English

As the monitoring body of the International Covenant on Civil and Political Rights (ICCPR), the Human Rights Committee (HRC) has always enjoyed a prominent position among treaty bodies which monitor the implementation of human rights treaties by states parties. One the functions performed by the HRC is the issuing of so-called General Comments on the ICCPR. A General Comment is a document whereby the HRC provides its interpretative commentary on one of the rights recognized by the ICCPR or other topics related thereto. As such, the General Comments are considered as a prime examples of treaty interpretation. The question to be answered in this respect is, given the various methods of interpretation, which Interpretive method or methods is used by the HRC in its General Comments? To answer this question, the present paper adopts an inductive approach so as to use statistical data about the subject. The results indicate that the teleological method is pervasive in the General Comments of the HRC.
