ماهیت حقوقی قراردادهای فروش تسلیحات بین ایران و آمریکا

چکیده
روابط ایران و ایالات متحده با کودتای 1953 (28مرداد 1332) وارد فصل جدیدی شد و تا رفتن شاه از ایران یعنی 26 دی‌ماه 1357 و مدتی پس از آن ادامه پیدا کرد. در این بین، قراردادهای زیادی به‌منظور خرید و فروش اقلام نظامی بین دو کشور امضا شد. با خاتمۀ روابط دوستانۀ دو کشور و پیرو آن امضای بیانیه‌های الجزایر و تشکیل دیوان داوری دعاوی ایران و آمریکا، ادعای نقض این قراردادها از سوی ایالات متحده مبنای طرح دعوا از سوی ایران علیه آمریکا در دیوان یادشده قرار گرفت که اکنون در حال رسیدگی است. با عنایت به عدم تصریح قانون حاکم در این قراردادها، تعیین قانون حاکم بر آنها از اهمیت بسزایی برخوردار است. تعیین ماهیت حقوقی این قراردادها از عوامل مهم در احراز قانون حاکم بر آنهاست. بر همین اساس، در این مقاله با اتکا به روش توصیفی و تحلیلی به دنبال پاسخ به این پرسش اساسی هستیم که ماهیت حقوقی قراردادهای فروش نظامی منعقده بین ایالات متحده و ایران چیست؟ با عنایت به وجود عناصر معاهده در این قراردادها، می‌توان گفت که قراردادهای مورد بحث در واقع معاهده در معنی مدنظر کنوانسیون حقوق معاهدات هستند.

چکیده English

After coup d'etat of 1953 in Iran, Iran's relations with the United States entered a new phase and continued until the Shah's departure from Iran on 9th Jan. 1979, and perhaps shortly thereafter that. Meanwhile, many contracts were signed to commerce  military items between the two countries. But with the end of friendly relations between the two countries and the subsequent signature of Algiers Accords and the establishment of Iran-United States Claims Tribunal, allegations of breach of these contracts formed the basis for a case filed by Iran in the tribunal which is still pending. Given the lack of governing law in these contracts, it is important to determine their governing law which is subject to determination of their legal nature. Thus, this paper seeks to determine legal nature of arms and military equipment contracts between the United States and Iran by conducting analytical research. Given the five reasons as a strong sign of the existence of treaty elements in these contract, it can be concluded that the contracts in question are in fact treaty under the in the sense of Vienna Convention on the Law of treaties.
