چکیده
امروزه جهان پیش‌روی ما، به مقررات حاکم بر شرکت‌های فراملی وابسته است و این شرکت‌ها به یکی از دغدغه‌های اساسی در سطح ملی و بین‌المللی تبدیل شده است. روش‌های استانداردسازی سنتی یا قاعده‌گذاری، ممکن است در خصوص ایجاد تعهدات حقوق بشری برای شرکت‌های فراملی به‌ویژه در کشورهای در حال توسعه چندان مناسب نباشد و از ضمانت اجرای مقتضی برخوردار نباشد. در نتیجه، لزوم استانداردسازی قوانین موجود در جهت عملکرد بهتر هم در سطح بین‌الملل و حقوق داخلی و حتی مقررات موجود در شرکت‌ها ملاحظه می‌شود. در پی فعالیت این شرکت‌ها، این سؤال مطرح می‌شود که الزام به رعایت قوانین حقوقی و یا نقض این قوانین و استانداردها تا چه حد است؟ به‌نظر می‌رسد جهانی شدن و ایجاد تغییرات ساختاری در عملکرد دولت‌ها را شاید بتوان از مهم‌ترین علل افزایش قدرت و به‌تبع آن نقش شرکت‌های فراملی و جذب سرمایه‌گذاری خارجی در سطوح داخلی و بین‌المللی دانست که در این زمینه در برخی موارد تعهدات اخلاقی حقوقی به‌صورت خودکار رعایت می‌شوند و در برخی دیگر، استانداردهای حقوقی نقض می‌شوند، در نتیجه نیازمند ایجاد نظم و استانداردسازی حقوقی‌اند. در این مقاله با استفاده از روش تحلیلی_توصیفی، به بررسی اهداف سرمایه‌گذاری خارجی توسط شرکت‌های فراملی به‌عنوان هدف اصلی و بررسی چالش‌های موجود در این زمینه پرداخته می‌شود.

چکیده English

Today, the world depends on the rules governing transnational corporations, and transnational corporations have become one of the main concerns at the national and international levels. The method of traditional standards does not meet the requirements of traditional standards in all countries and does not have the guarantee of proper implementation. Internal and even existing regulations in companies are considered. Following the activities of these companies, the question arises as to what is the obligation to comply with legal laws or violate these laws and standards? It seems that globalization and structural changes in the performance of governments can be considered as one of the most important reasons for increasing power and, consequently, the role of transnational corporations and attracting foreign investment at the domestic and international levels. Legal ethics are automatically observed, and in others, legal standards are violated, so they need to establish legal order and standardization. In this paper, using a descriptive-analytical method, the objectives of foreign investment by transnational companies as the main goal and the challenges in this field are examined.
