دگردیسی نظام حقوقی در زمینۀ فضای سایبر

چکیده
گسترش روزافزون استفاده از فضای سایبر منشأ ایجاد چالش‌های جدیدی در ارتباط با نحوۀ ساماندهی و تنظیم روابط اشخاص در فضای سایبر بوده است. در این زمینه دو رویکرد متفاوت وجود دارد. رویکرد نخست با تأکید بر ویژگی‌های فضای سایبر و همچنین پویایی نظام حقوقی در پی ایجاد یک نظام حقوقی جدید برای فضای سایبر است و رویکرد مقابل با تأکید بر ظرفیت‌های نظام‌ حقوقی و چهره‌ابزارگونه فضای سایبر، تنظیم این فضا با نظام‌های حقوقی موجود را شدنی می‌داند. اتخاذ هریک از رویکردهای مزبور در حوزۀ اجرا با چالش‌هایی همراه است؛ ازاین‌رو این نوشتار با روش توصیفی- تحلیلی و با استفاده از منابع کتابخانه‌ای به این نتیجه رسیده است که با اتخاذ رویکرد میانه، می‌توان ضمن رفع نواقص هریک از این رویکردها، مقدمات ساماندهی فضای سایبر را نیز به‌نحو مناسب‌تری فراهم کرد.

چکیده English

The growing use of cyberspace has been the source of new challenges in how to organize and regulate people's relationships in cyberspace. There are two different approaches in this regard. The first approach seeks to create a new legal system for cyberspace by emphasizing the characteristics of cyberspace and the other one considers it possible to regulate this space with the existing legal by focusing on the capacities of the legal system and the tools of cyberspace, systems. Adopting any of these approaches in the field of implementation is confronted with challenges; Therefore, this paper using a descriptive-analytical method and library resources concludes that by adopting the middle approach, which eliminates the shortcomings of each approach, the preparations for organizing cyberspace can be provided in a more appropriate way.
