حقوق پناهندگان در اتحادیة اروپایی و رویة قضایی دیوان اروپایی حقوق بشر

چکیده
پس از پایان جنگ‌های جهانی، یکی از بزرگ‌ترین بحران‌ها در اروپا ورود پناهندگان است. در پی دنبال ایجاد اتحادیة اروپایی کنترل امور پناهندگی در قلمرو اتحادیه با نظر بر حفظ حقوق پناهندگان از اولویت‌های مهم کشورهای عضو اتحادیه تلقی می‌شود. پژوهش حاضر به‌دنبال بررسی چگونگی تضمین حقوق پناهندگان در اتحادیة اروپایی صورت گرفته است. فرض بر این است که شیوة تضمین حقوق پناهندگان در دو مرحله قابل بررسی است. پناهندگان در بدو ورود خود به اتحادیه مشمول مقررات تصویب‌شده از سوی ارگان‌های تقنینی اتحادیه در زمینة حقوق پناهندگان به‌هنگام ثبت و بررسی درخواست پناهندگی خواهند بود و در پی پذیرش درخواست پناهندگی و اقامت در کشورهای عضو اتحادیه، تضمین حقوق اقامتی آنها توسط دادگاه اروپایی حقوق بشر از طریق ایجاد رویه‌های مهم قضایی صورت می‌پذیرد. تعهد بر تضمین حقوقی که به‌واسطة ابتکار عمل اتحادیه و دادگاه اروپایی حقوق بشر برای پناهندگان در نظر گرفته شده است، همگام با سایر تعهدات حقوق بشری در این زمینه الزام‌آور است.

چکیده English

After the end of the world wars, one of the main crises in Europe is the influx of refugees. Following the establishment of the European Union controlling the refugee affairs in the territory of the European Union is considered as one of the most important priorities of the EU member states with regard to the protection of the rights of refugees. The present study seeks to examine how the rights of refugees are guaranteed in the European Union. The assumption is that the method of guaranteeing the rights of refugees can be examined in two stages. Upon arrival in the European Union, refugees shall be subject to the rules adopted by the EU's legislative bodies on the rights of refugees when registering and examining an asylum application and following the acceptance of their asylum application and residence in the Member States of the Union, their rights are guaranteed by the European Court of Human Rights through the establishment of important judicial precedent. The commitment to guarantee the rights provided to refugees by the initiatives of the European Union and the European Court of Human Rights is in line with other human rights obligations in this area.
