تعهد سرمایه‌گذار خارجی به توسعة اقتصادی دولت میزبان در انطباق با مفهوم توسعة پایدار

چکیده
بر اساس تعاریف ارائه‌شده از سرمایه‌گذاری خارجی و در انطباق با عناصر متشکل آن در علم حقوق، آمده است که سرمایه‌گذار باید به توسعة اقتصادی دولت میزبان کمک کند تا عمل او اساساً سرمایه‌گذاری تلقی شود. در دهه‌های اخیر با گسترش اهمیت حوزه‌هایی نظیر حقوق بشر، حقوق محیط زیست و حقوق کار، عمل سرمایه‌گذاری از مفهوم اقتصادی صرف فراتر رفته و افزون بر مشارکت مالی سرمایه‌گذار، تعهدی مبنی بر حمایت و انطباق فعالیت‌های مجاز او بر اساس قرارداد سرمایه‌گذاری در راستای حمایت و همسویی با مفهوم توسعة پایدار پدید آمده است. در این خصوص برخی از دیدگاه‌ها تحدید اندازه‌ای از فعالیت‌های مجاز سرمایه‌گذار خارجی را به‌واسطة مفهوم توسعة پایدار امری مجاز و ضروری دانسته‌اند. به شکلی که در آرای اخیر دیوان‌های داوری بین‌المللی و نیز توافقات بین‌المللی سرمایه‌گذاری از ایجاد بستری برای توسعة کشور سرمایه‌پذیر به‌عنوان یکی از مفاهیم اساسی تلقی سرمایه‌گذاری خارجی با توجه به مؤلفه‌هایی نوین نظیر الزامات حقوق بشر، کار و محیط زیست یاد شده است.

چکیده English

Based on the definition of foreign investment and its elements in law, it is contended that the investor should contribute to the economic development of the host state so that the latter’s action is considered an investment. In recent decades, with the growing importance of subject-areas like human, environmental, and labor rights, the act of investing has gone beyond the mere economic/financial concept and, has developed in line with the concept of sustainable development. In this regard, some commentators have considered it permissible and necessary to limit the scope of the permitted activities of the foreign investors within the frame of the concept of sustainable development. So much so that in recent arbitral decisions and international investment agreements, creating a platform for the development of the host state is considered a new component of foreign investment in line with the requirements of human rights, labor and environment rights.
