An examination of the historical trajectory leading to the contemporary approach of the global community indicates the precedence of international criminal justice over the immunity of state officials in serious international offenses. This approach is reflected in the practice of international courts, particularly the International Criminal Court. The International Law Commission, in its 2003 draft articles on "Immunity of State Officials from Foreign Criminal Jurisdiction", established a balance between justice and peace, asserting that heads of state, government leaders, and foreign ministers possess personal immunity from foreign criminal jurisdiction. On the other hand, it stated in 2017 that material immunity does not apply to crimes such as genocide, crimes against humanity, war crimes, apartheid, torture, and enforced disappearance. This research aims to analyze the prosecution of a head of states for international crimes, using a descriptive and analytical method along with library sources. By examining international legal sources, the study concludes that a head of state can be prosecuted for international crimes after the end of his/her term. However, the prosecution and surrender of a head of state to the competent authority in cases of international crimes requires the cooperation of the official's home state as well as other states.
