چکیده
ماهیت مرکب سازمان‌های بین‌المللی که از یک سو از شخصیت حقوقی مستقل برخوردارند و از سوی دیگر از اعضایی تشکیل شده‌اند که حیات سازمان تا حد زیادی منوط به آنهاست، اقتضائات و لوازم بسیاری، از جمله ضرورت وجود سازوکار نظارتی نسبت به عملکرد سازمان‌های بین‌المللی را ایجاب می‌کند. ضرورت وجود سازوکار نظارتی، در خصوص سازمان‌های بین‌المللی اقتصادی مانند بانک بین‌المللی ترمیم و توسعه، با توجه به ویژگی‌های خاص آن، بیش از دیگر سازمان‌ها احساس می‌شود. چنین سازوکار نظارتی بر سازمان‌های بین‌المللی، بدون تردید زمانی کارامد و مؤثر خواهد بود که منطبق با چارچوب‌ها و قواعد نظام حقوق بین‌الملل شکل گرفته باشد. بر این اساس در پژوهش پیش‌رو تلاش شده است با روش پژوهش توصیفی‌ـ تحلیلی و روش جمع‌آوری اطلاعات کتابخانه‌ای به این پرسش مهم پاسخ داده شود که آیا سازمان‌های بین‌المللی پس از تأسیس تحت سازوکار‌های نظارتی کارامد، شفاف و از پیش تعیین‌شده قرار خواهند گرفت یا خیر. به‌طور کلی با توجه به ویژگی‌های ذاتی نظام حقوق بین‌الملل سازوکارهای نظارتی مؤثری در آن پیش‌بینی نشده است؛ اما به اعتقاد نگارنده یک رکن نظارتی دائمی و مبتنی بر سند تأسیس سازمان و همتراز با رکن فراگیر، می‌تواند بالاترین سطح نظارت را در یک سازمان بین‌المللی رقم بزند.

چکیده English

The complex nature of international organizations, which have independent legal personality and on the other hand, are composed of members on whom the life of the organization depends; It requires many requirements and supplies, including the necessity of the existence of a monitoring mechanism for the performance of international organizations. The need for a regulatory mechanism is felt more than other organizations in the case of international economic organizations such as IBRD. Such a monitoring mechanism for international organizations will be efficient and effective without a doubt when it is formed in accordance with the frameworks and rules of the international law system. Therefore, in the upcoming research, an attempt has been made to answer whether international organizations will be subject to efficient, transparent and predetermined regulatory mechanisms after their establishment, using the descriptive-analytical research method and library information collection method. In general, due to the inherent characteristics of the international law system, effective regulatory mechanisms are not foreseen in it; But according to the author's belief, a permanent monitoring pillar based on the organization's founding document and on par with the comprehensive pillar, can set the highest level of supervision in an international organization.
