Privatization as an effective tool for shrinking the government, reducing costs, and increasing people’s participation in the country’s economic affairs has always been the concern of governors. In Iran, despite the passage of half a century since the enactment of initial legal provisions regarding privatization, a limited number of State-owned enterprises have been transferred to the real private sector, with some encountering significant challenges. In the current research, by reviewing the six decisions of the “Article (30) arbitration panel” and several judicial judgments related to the transfer of three companies “Moghan Agro-industry and Livestock,” “Biston Petrochemicals,” and “Sonqor Old Silo,” with a descriptive and analytical view concerning library sources, we found that irrelevant considerations and the error of fact in the court’s judgments, the ambiguity in the jurisdiction between the arbitration panels and courts in claims of compensation for damages, the lack of attention to the sanctity of contracts in the court’s decisions and accordingly, the absence of judicial protection from private investors are considered essential flaws in the handling of lawsuits related to transferences. So, it seems impossible to continue moving toward privatization without solving the mentioned issues.
