چکیده
استفاده از نظام تصمیمگیری خودکار در امور عمومی موجب طرح نگرانیهایی در خصوص نحوۀ تضمین حقوق افراد-درصورتیکه مشمول این نوع تصمیمگیری شوند- شده است. بهمنظور کاهش این نگرانی کشورهای مختلف شروع به مقرراتگذاری استفاده از این شیوه در چارچوب مدیریت عمومی کردهاند. این مقاله به روشی توصیفی –تحلیلی و با بهرهگیری از منابع کتابخانهای نگاشته شده است. نتایج پژوهش نشان میدهد اغلب کشورها به گسترش تصمیمگیری خودکار با پیشنهاد و تصویب قوانین مربوط به حفاظت از داده واکنش نشان دادهاند. معدود کشورهایی نیز در چارچوب قواعد کلی حقوق اداری، وضع قوانین جدید یا اصلاح قوانین موجود، نظام تصمیمگیری خودکار را مقرراتگذاری کردهاند. دستهای هم با رویکردی بخشی، تنها حوزههایی خاص از ادارة امور عمومی را مشمول اعمال این نوع تصمیمگیری دانستهاند. در نتیجه وضع یک چارچوب مقرراتی خاص، ویژه و جامع برای نظمبخشی به این شیوۀ تصمیمگیری که تبیینگر موقعیتهای استفاده از آن در مدیریت عمومی و اصول حاکم بر اجرایی ساختن آن و نیز دربردارندۀ تضمینهای مناسب بهمنظور حفظ حقوق افراد در جریان حق بر ادارۀ خوب باشد، ضروری است.

چکیده [English]
Background: The use of automatic decision-making system in public affairs has raised concerns about how to guarantee people's rights - if they are subject to this type of decision-making. In order to reduce this concern, different countries have started to regulate the use of this method in the framework of public administration. Method: The article written in a descriptive-analytical way using library resources. Results: The results of the research show that most countries have reacted to the expansion of automatic decision-making by proposing and passing laws related to data protection. A few countries have regulated the automatic decision-making system within the framework of the general rules of administrative law, establishing new laws or amending existing laws. A group with sectoral regulation has considered only specific areas of public affairs administration to be subject to this type of decision-making. Conclusion: it is necessary to establish a special and comprehensive regulatory framework to regulate this decision-making method, which explains the situations of its use in public administration and the principles governing its implementation, as well as including appropriate guarantees in order to protect the rights of individuals in the exercise of the right to good administration.
