چکیده
با افزایش آگاهی در زمینة شرایط وخیم محیط زیست و اهمیت توسعة پایدار، دولت‌ها اقدام به اتخاذ دامنة وسیعی از معیارها در راستای حفاظت از بهداشت، ایمنی و محیط زیست کردند. معیارهای بهداشت، ایمنی و محیط زیست به‌طور کلی در پی حمایت از مردم در مقابل خطرهای تهدیدکنندة بهداشت، ایمنی و محیط زیست و تغییر الگوهای تولید و مصرف است. این موضوع در کنار ظهور ویروس کووید 19 که اولین‌بار در اواخر سال 2019 در چین کشف شد و از آن زمان پاندمی جهانی یافت، جهان بشریت را با چالش‌های بی‌سابقه‌ای رو‌به‌رو کرده است. کووید 19 که در وهلة اول یک بحران بهداشتی می‌نمود، نه‌تنها بر زندگی روزمرة انسان تأثیر گذاشت، اقتصاد جهانی و روابط تجاری میان کشورها را متأثر ساخت. پژوهش حاضر درصدد بررسی این موضوع است که آیا با وجود سازمان تجارت جهانی و قواعد تجارت آزاد در شرایط همه‌گیری این ویروس، کشورها می‌توانند با توسل به HSE در روابط تجاری خود محدودیت‌های قانونی وضع کنند؟ بررسی موافقت‌نامه‌های سازمان تجارت جهانی حاکی از آن است که این سازمان برای اعضای خود این امکان را در نظر گرفته تا در شرایط خاص و اضطراری حفظ سلامت و بهداشت شهروندان خود را در اولویت قرار دهند و اصول بنیادین سازمان را به‌صورت موقت نادیده بگیرند.

چکیده [English]
With increasing awareness of the dire conditions of the environment and the importance of sustainable development, governments adopted a wide range of measures in order to protect health, safety and the environment. HSE measures generally seek to protect people against HSE risks and changing production and consumption patterns. This issue, along with the emergence of the Covid-19 virus, which was first discovered in late 2019 in China and has since become a global epidemic, has made the world of humanity face unprecedented challenges. Covid-19, which was a health crisis in the first place, not only affected the daily life of people, but also affected the global economy and trade relations between countries. This article tries to investigate whether, despite the World Trade Organization and free trade rules, in the context of this virus epidemic, countries can impose legal restrictions in their trade relations by resorting to HSE? Examining the agreements of the World Trade Organization indicates that this organization has considered the possibility for its members to prioritize the health and safety of their citizens in special and emergency situations and temporarily ignore the fundamental principles of the organization.
