قانون اساسی به‌مثابة اصول تأسیسی دولت ارگانیک در ایدئالیسم مطلق هگل

چکیده
قانون اساسی در رویکرد متعارف در حقوق اساسی ایران به‌عنوان یک مفهوم انتزاعی و قابل تعریف یا یک سند قانونی موضوعیت دارد. این تلقی مستلزم پذیرش جامعۀ مدنی و دولت مبتنی بر رویکرد مکانیکی است. این در حالی است که در ایدئالیسم مطلق هگل، قانون اساسی به‌مثابۀ اصول تأسیسی دولت ارگانیک مطرح می‌شود که در بستر زندگانی اخلاق‌گرایانه محقق می‌شود. زندگانی اخلاق‌گرایانه در نظرگاه هگل یک پدیدۀ مکانیکی نیست، بلکه فراگردی پویاست که در بستر آن وحدتی ناتمام متعین و متشکل می‌شود. سیر ارگانیک از وحدت به ناهمسانی و از ناهمسانی به وحدت در ناهمسانی است که نهادهای متکثر و متعدد جامعۀ مدنی را در صورت دولت شکل می‌دهد و به وحدت می‌رساند. دولت ارگانیک در نظام فکری هگل نه به‌عنوان یک نهاد سیاسی یا ساختار حاکمیتی صرف، بلکه به‌مثابة یک ارگانیسم تکامل یافته و به‌عنوان آخرین مرحله از تکامل روح در تاریخ موردنظر است؛ فرایند رشد ارگانیک دولت، قانون اساسی را به‌عنوان اصول تأسیسی آن، از یک مفهوم صوری و انتزاعی به یک ایدۀ محقق تاریخی و انضمامی تبدیل می‌سازد.

Constitutional Foundations of the Organic State in the Context of Hegel’s Absolute Idealism

چکیده English

In the conventional approach to constitutional law in Iran, the constitution is considered either an abstract and definable concept or a legal document. This perspective presupposes a civil society and a state based on a mechanical approach. In contrast, in Hegel’s absolute idealism, the constitution is regarded as the foundational principles of an organic state, realized within the context of ethical life (Sittlichkeit). In Hegel’s view, ethical life is not a mechanical phenomenon; rather, it is a dynamic process through which an incomplete unity becomes determinate and structured. The organic development moves from unity to plurality and from plurality back to unity within plurality, shaping the multiple and diverse institutions of civil society into a coherent state. In Hegel’s system of thought, the organic state is not merely a political institution or a governing structure but an evolved organism, representing the final stage in the historical development of Spirit. This organic growth process elevates the constitution, as the foundational principles of the state, from a formal and abstract concept to a historically realized and concrete idea.
