A Representation of the Shortcomings of Hart's Rejectionist Theory in Relation to the International Legal System

English

In the realm of law, the greatest challenges regarding this controversial concept pertain to international law; and whether what is called international law possesses legal quality and the elements of a legal system. In this regard, H.L.A. Hart's contribution in the 20th century holds a key status, and centering his perspective (affirming legal quality and denying the systematicism of international law) reflects the full spectrum of ontological and systemic views to international law. Hart, by rejecting Austin's (Command) theory as the last influential denier of international law, emphasizing the necessity of a realistic view of the power-based sovereignty-centered context of the international order, views sovereignty as a legal concept above state power. Meanwhile, Hart considers international law to lack a complete form of governance and to be merely a collection of rules lacking secondary rules of recognition (for determining legal sources and criteria for identifying legal rules), change, and adjudication (for legislation and judiciary), and therefore, it does not conform to a legal system (a union of primary and secondary rules). However, the prevailing contemporary doctrine, rejecting Hart’s extreme formalism, recognizes the ultimate rule of recognition and the functions of the triad of legislation, adjudication, and enforcement, albeit imperfectly, within the international legal order. Undoubtedly, denying the organizational nature of international law means casting doubt on the key functions in this domain, such as law creation and adjudication.
