تسلیح معارضان سوریه از منظر حقوق بین‏الملل

چکیده
از زمان شروع بحران سوریه بیش از پنج سال می‏گذرد. آنچه در طولانی شدن این بحران بسیار حائز اهمیت است حمایت‏های مالی و لجستیکی برخی کشورهای منطقه‏ای و فرامنطقه‏ای است. این در حالی است که اقدام کشورهای تسلیح‌کننده نه‌تنها ناقض اصل منع توسل به زور به جهت دخالت در کشور سوریه به شمار می‏آید، بلکه، به موجب اصل عدم مداخله، حمایت‌های تسلیحاتی صورت‌گرفته به بهانه‏های بشردوستانه و متقابل نیز نمی‏تواند ادله‏ای پذیرفتنی در عرصة بین‌المللی دانسته شود. همچنین، به موجب دلایل بیان‌شده، توجه به برگزاری انتخابات صورت‌گرفته در سال 2014 و انتخاب قاطع بشار اسد، به سِمَت ریاست‌جمهوری، تسلیح معارضان به بهانة حق تعیین سرنوشت فاقد وجاهت بین‏المللی است. بر اساس آنچه بیان شد، در تدوین مقالة پیش رو، به‌مثابة تحقیقی بنیادی و راهبردی، سعی شد به کمک روش‏های توصیفی‏، ضمن بیان توجیهات ارائه‌شده در زمینة ارسال سلاح و تجهیزات نظامی‌ ‏و تأمین مالی به معارضان سوری به کمک مبانی حقوق بین‏الملل، پاسخی مستدل ارائه شود.

چکیده English

It has been over five years since the Syrian crisis has begun. Financial and logistical support of regional and trans-regional States have played a key role in the prolongation of this upheaval. Arming the Syrian opposition not only violates the principle of prohibition on use of force, but also falls short of the imaginable scope of both the principle of humanitarian intervention and the principle of counter-intervention. Additionally, as Bashar Al-Assad was elected president in the 2014 elections, the mentioned act is also illegitimate under the principle of the right of nations to self-determination. Based on a descriptive method, this article provokes international principles to argue against justifications applied to aid the Syrian rebels.
