اساس جانشینی دولت‌ها در زمینۀ تعهدات ناشی از اعمال متخلفانۀ بین‌المللی

چکیده
جانشینی دولت‌ها در زمینۀ تعهدات ناشی از اعمال متخلفانۀ بین‌المللی، به لحاظ موضوعی، ذیل مقولۀ کلان‌تر جانشینی در زمینۀ مسئولیت بین‌المللی مطرح است که در مورد آن نظرهای مختلفی وجود دارد. مقالۀ حاضر، کوشیده است تا با روش توصیفی-تحلیلی، به این پرسش پاسخ دهد که اساس جانشینی کشورها در زمینۀ تعهدات ناشی از اعمال متخلفانۀ بین‌المللی چیست؛ ازاین‌رو، نخست به تبیین دیدگاه مبنی بر عدم انتقال مسئولیت، به‌عنوان امری که قائلان به عدم جانشینی کشورها در زمینۀ تعهدات ناشی از اعمال متخلفانه بدان تکیه کرده­اند، پرداخته و سپس اصل عدم زوال مسئولیت را، به‌عنوان گزاره‌ای که قائلان به جانشینی کشورها در زمینۀ تعهدات یادشده به آن استناد کرده‌اند، بررسی کرده است. براساس نتایج تحقیق پیش رو، جانشینی کشورها در زمینۀ تعهدات ناشی از اعمال متخلفانۀ بین‌المللی، به‌رغم تمام نظرهای مخالفی که به‌ویژه در آثار کلاسیک حقوق بین‌الملل وارد شده است، با مانعی در حقوق بین‌الملل مواجه نیست تا در برابر انتقال تعهدات ناشی از اعمال متخلفانۀ بین‌المللی به دولت جانشین مقاومت کند. بررسی این گزاره، موضوع مقالۀ پیش روست.

چکیده English

Succession of states to obligations resulting from international wrongful acts is related to the broader topic of succession to international responsibility about which there are very different opinions. Applying a descriptive-analytical method, the present paper is seeking to explain the basis of state succession to obligations in respect of international wrongful acts. Moreover, it explains the principles of non-transmission and of continuance which the advocates of non-succession have relied on. In spite of all the dissenting opinions, especially in classical scholarship, this article comes to the conclusion that there are no impediments in international law to prevent the transfer of obligations in respect of international wrongful acts. Scrutinizing this proposition is the subject of the present paper.
