مسئولیت دولت‌ها در حمایت از گروه‌های تروریستی با تأکید بر قضیة تادیچ

چکیده
قابلیت انتساب اقدام‌های گروه‌های تروریستی به دولت‌ها، از موضوعات مناقشه‌برانگیز و مهمی است که صلح و امنیت بین‌المللی را دچار تزلزل کرده است. در همین زمینه نگارنده در پژوهشی به‌صورت توصیفی تحلیلی و با استفاده از روش کتابخانه‌ای به بررسی موضوع پرداخته است. نتایج نشان می‌دهد که میان نظریات کنترل کلی و کنترل مؤثر، نظریة مسئولیت کلی به‌مراتب بهتر از کنترل مؤثر تبیین‌کنندة مسئولیت دولت‌ها در حمایت از گروه‌های تروریستی است. نظریة کنترل کلی برگرفته از رأی شعبة تجدیدنظر دادگاه بین‌المللی کیفری برای یوگسلاوی سابق در قضیة تادیچ است که با رد تصمیم شعبة بدوی، این دادگاه معتقد بود معیار کنترل مؤثر که توسط دیوان بین‌المللی دادگستری ارائه شد، مغایر با منطق مسئولیت دولت‌هاست. البته نظریة کنترل کلی نیز در تبیین انتساب اعمال گروه‌های تروریستی به دولت‌ها، با چالش‌هایی مواجه است؛ نخست آنکه ارتباط دولت‌ها و گروه‌های تروریستی مانند داعش وضعیت پیچیده‌ای به خود می‌گیرد که امکان بررسی میزان حمایت دولت‌ها از این گروه چندان ساده به‌نظر نمی‌رسد، زیرا دولت‌ها تلاش می‌کنند رابطة خود با این نوع گروه‌ها را کاملاً مخفی نگه‌دارند؛ دوم اینکه گاهی همان کنترل کلی نیز در خصوص گروه‌های تروریستی مانند داعش وجود ندارد. به‌عبارتی با اینکه دولت‌ها از این گروه‌ها حمایت می‌کنند، اما این گروه‌ها کاملاً مستقل عمل می‌کنند. افزون‌بر این، رویة قضایی واحدی در این خصوص وجود ندارد و همین مسئله تبیین و انتساب همة فعالیت‌های گروه‌های تروریستی با دولت‌ها را با چالش مواجه کرده است.

چکیده English

The attribution of actions by terrorist groups to states is a controversial and important issue that has undermined international peace and security. The author has conducted a descriptive-analytical study on this subject using library research methods. The results show that between the two theories of overall and effective control the former provides a much better basis regarding the responsibility of states for supporting terrorist groups. The theory of overall control was established by the ICTY’s Appeals Chamber in the Tadic case, which argued that the effective control criterion provided by the International Court of Justice was contrary to the logic of state responsibility. Of course, the theory of overall control is facing challenges in terms of explaining the attribution of terrorist groups to states. Firstly the relationship between supporting states and terrorist groups such as ISIS is so complicated that it is not easy to examine the extent to which governments support such groups, as they try to keep their ties to these groups completely secret. Secondly, in some cases even overall control over terrorist groups such as ISIS does not exist. In other words, despite the fact that these groups are supported by states, they operate independently. In addition, there is no unified case law in this regard, and this makes it difficult to attribute the activities of terrorist groups to states.
