چکیده
مبادلات مالی در حیات اقتصادی جوامع گوناگون، هیچگاه به روشهای رسمی مورد تأکید دولتها منحصر نبوده است، بلکه همواره حسب نیازهای اقتصادی افراد هر جامعه روشهایی به ابتکار دولتها، به موازات سازوکارهای رسمی بهمنظور جابهجایی وجوهات و اعتبارات بهکار گرفته شده است. این روشهای پرداخت جایگزین، افزونبر مرتفع کردن نیازهای مشروع جوامع مذکور، گاه توسط مجرمان و در راستای ارتکاب جرائمی مانند پولشویی و تأمین مالی تروریسم نیز بهکار گرفته شدهاند تا روند اکتشاف و تعقیب این جرائم را برای دولتها دشوارتر سازند. در همین زمینه اسناد بینالمللی مانند کنوانسیونهای مبارزه با فساد و مقابله با تأمین مالی تروریسم و توصیهنامههای گروه ویژة اقدام مالی بهطور مفصل و قطعنامة 1373 شورای امنیت بهطور ضمنی، سعی در ترغیب دولتها برای اعمال نظارت و اتخاذ راهکارهایی بهمنظور مقابله با سوءاستفادههای اینچنینی کردهاند. در این مقاله با استفاده از روش تحلیلی و با تطبیق نظم حقوقی موجود در جمهوری اسلامی ایران مشخص شد که اگرچه کشورمان سعی کرده است تا خود را با استانداردهای بینالمللی در ارتباط با نظامهای پرداخت جایگزین در جرم پولشویی منطبق سازد، هنوز در این باره در قوانین و مقررات نقصان وجود دارد. نقصان مذکور در جرم تأمین مالی تروریسم نیز بهصورتی بارزتر موجود است که نیازمند اقدامهای تقنینی مشخصی در این زمینه است.

چکیده [English]
Financial transactions within the economic life of various societies have never been confined to formal methods approved by states. To the contrary, based on the economic needs of individuals in every society, parallel to the formal mechanisms, other methods are employed for transferring funds and credit. Nonetheless, these alternative remittance systems, in addition to meeting legitimate needs, have sometimes been used by criminals for committing crimes such as money laundering and financing of terrorism to the effect that tracing and prosecuting the crimes becomes more difficult.International instruments such as the United Nations Convention against Corruption International Convention for the Suppression of the Financing of Terrorism, recommendations by the Financial Action Task Force, as well as Security Council Resolution 1373, have sought to encourage states to implement measures to combat such abuses. In recent years, the Islamic Republic of Iran has likewise made a considerable effort to ensure that its national legal system meets the standards laid down in international instruments, even as these endeavors require increased revision and update.
