هستی‌شناسی حقوق بین‌الملل؛ از انکار تا پذیرش نظری-کارکردی

چکیده
معمای دیرپای «حقوق» بودن حقوق بین‌الملل، از مقدماتی‌ترین چالش‌هایی است که حقوق بین‌الملل همواره با آن مواجه بوده و حتی در شاخه‌های مدرن حقوق بین‌الملل هم پرسش در خصوص کیفیت حقوقی، هنوز حدیث مکرر است. در پاسخ به ایراداتی نظیر اینکه حقوق بین‌الملل نه از فرمان حاکمیت، بلکه صرفاً از ملاحظات اخلاقی سرچشمه می‌گیرد و نمی‌تواند «حقوق» خوانده شود، صاحب‌نظران با تأکید بر توزیع نابرابر قدرت میان دولت‌ها به‌عنوان یک واقعیت در جامعۀ بین‌المللی، ضعف ضمانت اجرا در یک شاخۀ حقوقی را دلیل بر نفی آن نمی‌دانند، شکل مجازات را در جوامع داخلی و بین‌المللی به‌کلی متفاوت می‌یابند و حقوقی بودن مفهوم «حاکمیت» و ارادۀ دولت‌ها به‌مثابۀ بنیانی قطعی در حقوق بین‌الملل را به‌عنوان شاهد این مدعا مطرح می‌کنند. در کنار سایر پاسخ‌های ظریف نظری در دفاع از موجودیت حقوقی حقوق بین‌الملل، با الهام از نظرگاه جامعه‌شناسی حقوقی، می‌توان از کارکردها و اشتغالات حقوق بین‌الملل نیز بهره جست. به اقتضای کارویژۀ اجتماعی حقوق بین‌الملل و با تأکید بر اینکه هر کجا جامعه‌ای هست حقوق هم هست، گریزی از پذیرش شاخصۀ حقوقی حقوق بین‌الملل نیست. تلاش همۀ جوامع برای نیل به منفعت جمعی مشترک، استفادۀ آن جامعه از حقوق را اجتناب‌ناپذیر می‌سازد و جامعۀ بین‌المللی، این جامعۀ مشترک همۀ دولت‌ها، چاره‌ای جز بهره‌گیری از حقوق بین‌الملل ندارد.

چکیده English

The riddle of international law being ” law” has consistently been one of the primary challenges international law has encountered, even in its relatively more modern branches. In response to authors like Austin who contended that international legal norms are not law but morality, some scholars asserted that despite the uneven distribution of power among states, the weakness of sanctions in a legal order does not mean that it does not exist. Also, the notions of sovereignty and the will of states, as the basis of international relations, are legal conceptions and so, international law literally does exist. In fact, the unique elements of the international society and hence international law need to be thoroughly digested. Furthermore, a functional approach leads us to the legal quality of international law. Undoubtedly, all society-based relations and the collective struggle of society members to gain common interest require some sort of law. In other words, it is inevitable that the international community needs international law.
