تأملی بر مقررات‌گذاری خودتنظیمی در فضای سایبر

چکیده
از بدو ورود فضای سایبر به زندگی بشر، تاکنون شیوه‏های گوناگونی در خصوص نظام‌مندسازی آن مطرح شده است. در این میان خودتنظیمی که به دستور‏دهی خصوصی و مقررات‌گذاری غیرمتمرکز تعبیر می‏شود، به‌عنوان روشی کارا مورد توجه حقوقدانان قرار گرفته ‏است. این رویکرد که تابعی از گفتمان جدایی‌انگاری فضای سایبر است، شیوة مقررات‌گذاری ملی را برای تنظیم فضای سایبر ناکارامد می‏داند. «پرسش جدی در ارتباط میان خودتنظیمی و فضای سایبر آن است که چارچوب‏های نظری خودتنظیمی در فضای سایبر چه بوده و چه نقاط قوت و ضعفی بر آن شیوه مترتب است؟». پژوهش پیش‌رو با کاربست روش توصیفی-تحلیلی، معماری فضای سایبر را برخاسته از ارتباط نظام‏مند لایه‏ها، مسائل و بازیگران گوناگون دانسته و آن را مرزی جدید و محدوده‏ای نو به‌شمار آورده است. با توجه به این مشخصه می‏توان خودتنظیمی را شیوه‏ای کارامد در مقررات‌گذاری نه تمامی لایه‏ها و مسائل، بلکه در موارد زیرساختی و فیزیکال به‌ویژه اعمال تصدی‌گرایانه محسوب کرد.

چکیده English

Since the introduction of cyberspace into human life, various ways have been suggested for regulating it. In this context, self-regulation, in the sense of private regulation and decentralized law-making, has come to fore as an efficient way for managing the online world. This approach, as a function of the libertarian discourse, views national legislation ineffective in regulating the cyberspace. But the theoretical framework of this kind of self-regulation and its strengths and weaknesses are open to debate. This study, using a descriptive-analytical approach, considers the architecture of cyberspace to be a systematic link between different layers, issues, and actors, and as such a new frontier. Given this feature, self-regulation can be an efficient way of regulating not just the various layers and issues of the cyberspace but also its physical and infrastructure issues.
