چکیده
حکمرانی جدید، بستری نظری جهت تعامل دوسویة حکومت و شهروندان است، که بهمنظور عملیاتی شدن، نیازمند سازماندهی مؤثر ساختار اداره عمومی است. مهمترین ویژگی آن، تکثرگرایی ذاتی و اجتناب از وحدتگرایی است؛ ازاینرو علاوه بر چندگانگی ظاهری، از بنیانهای متکثر پیروی میکند. هدف تحقیق، واکاوی الزامات اجرایی حکمرانی جدید، بررسی نسبت آنها با یکدیگر و نگاهی به وضعیت ایران در این حوزه است. بنابراین با استفاده از شیوة کتابخانهای، منابع مرتبط با موضوع، گردآوری و ابزارهای تنظیمگری، حقوق نرم و مشارکت عمومی-خصوصی، بهعنوان مؤلفههای اصلی، شناسایی و با روش توصیفی-تحلیلی، نخست بهصورت مستقل و سپس در تعامل با یکدیگر، بررسی شدند. براساس یافتههای تحقیق: 1. سه مؤلفة مذکور از نسبت همگرایی و وابستگی توأمان نسبت به یکدیگر برخوردارند؛ 2. مقدمة ضروری تحقق آنها، بهرهگیری از رویکرد غیرمتمرکز نسبت به تنظیم گری است؛ 3. اصلاح قانون اجرای سیاستهای کلی اصل ۴۴، در راستای حرکت از تنظیم گری دولتی بهسوی تنظیمگری غیرمتمرکز، ضروری بهنظر میرسد؛ 4. وضع قانونی خاص در خصوص پیمانهای فیمابین بخش خصوصی و دولتی، که در آن فضاهایی به بهرهگیری از حقوق نرم و ابزارهای تنظیم گری همچون تنظیم توافقی، اختصاص یابد، میتواند مسیر تحقق حکمرانی جدید در ادارة عمومی ایران را هموار سازد.

چکیده [English]
The new governance can be seen as a theoretical framework for the two-way interaction between the government and the citizens, which requires effective organization in the public administration structure in order to be operational. Its most important feature is inherent pluralism and avoidance of unitarism; Therefore, in addition to apparent multiplicity, it follows multiple foundations. The purpose of the research is to analyze the executive requirements of the new governance, to examine their relationship with each other, and to analyze Iran's situation in this field. Therefore, by using the library method, relevant sources were collected, and regulatory tools, soft rights and public-private partnership, as the main components, identified and with a descriptive-analytical method, first independently and then in interaction with each other were examined. Based on the findings of the research: 1. The three mentioned components have the ratio of convergence and twin dependence on each other; 2. The essential prelude to their realization is the use of a decentralized approach to regulation; 3. It seems necessary to amend the General Policy Implementation Law of Article 44 in order to move from government regulation to decentralized regulation; 4. A special legal status regarding the contracts between the private and public sector, in which spaces are allocated for the use of soft rights and regulatory tools such as negotiated regulation, can pave the way for the realization of new governance in Iran's public administration.
